Silly Homeowner Association Rules

Interesting article in the Post and Courier about a clash between a person’s desire to fly a flag from another country and some way too silly homeowner association rules.  

It's things like this that drive me crazy about homeowner associations and the attorneys some developers use to write their governing documents and by-laws.

Before you put a rule in place, ask yourself these questions:

1.  What are the implications or who is damaged if the rule isn't followed?

2.  Can the rule be reasonable and fairly enforced?

If the answer is "No" to either of these, don't have the rule.

If after the adoption of the governing documents and by-laws and there is a need/desire to add any additional rules, have a "sunset clause" for the rule requiring it to go away after a year and have to be re-adopted if the need for the rule still exists.
